Rauika Terms and Conditions

Te Puni Kōkiri accepts all applications from event organisers (“organisers”) for events to be published on Rauika on the following Terms and Conditions:

  1. Applications will only be accepted for publication if they support the kaupapa of Te Puni Kōkiri, which will be assessed at the sole discretion of Te Puni Kōkiri.
  2. The applicant undertakes to Te Puni Kōkiri that no advertisement will;
  • give rise to any claims or liabilities for Te Puni Kōkiri;
    • infringe copyright, trade mark or other intellectual or industrial property rights of any person;
    • contain material that is obscene, offensive, defamatory, or otherwise unsuitable for publication;
    • be, or likely to be, misleading or deceptive or otherwise infringe the Fair Trading Act 1986 or any other statute, regulation or rule of law;
    • infringe any person’s rights under the Privacy Act 2020;
    • infringe commercial rights;
    • be used for party political purposes.
  1. By submitting or authorising submission of an advertisement for publication, the organiser;
  • indemnifies Te Puni Kōkiri (and its employees and agents) against any proceedings, demands, losses, costs (including legal costs), damages and other liabilities incurred by Te Puni Kōkiri (and/or its employees and agents) in connection with the advertisement;
  • confirms that where appropriate, all necessary arrangements have been made for the holding of the event with regard to but not limited to health and safety, public liability insurance, compliance with rules and legislation relating to holding events in a public place, licences including food and drink, noise, the installation and removal of equipment, leaving the venue and surrounding areas in a clean and tidy condition and ensuring there is no damage to fixtures or property.
  1. Te Puni Kōkiri may in its discretion;
  • without notice to the organiser, alter or abbreviate any advertisements, refuse to publish, cancel or refuse to continue publishing any advertisement without providing any reason for this rejection, providing this right will not be unreasonably exercised;
  • re-publish advertising in other Te Puni Kōkiri publications and media without cost to the organiser;
  1. Except as expressly provided in these Terms and Conditions, Te Puni Kōkiri excludes all warranties, representations and conditions whether implied or otherwise and in no circumstances will Te Puni Kōkiri (its employees or agents) be liable whether in tort, contract or otherwise for any loss or damage suffered by the organiser or any other person.
  2. Te Puni Kōkiri will not be liable to the organiser or any other person for any loss suffered as a result of an advertisement not being available for publication where such event arises from any cause beyond its control, which includes any partial or complete breakdown of Te Puni Kōkiri’s operations or network.
  3. As well as being republished on other Te Puni Kōkiri publications and media, any personal information provided by applicants may also be used for internal reporting and monitoring purposes.
  4. No modification or variation to these Terms and Conditions will have effect unless it is in writing signed by both Te Puni Kōkiri and the organiser.
  5. These Terms and Conditions are governed by, and construed in accordance with the laws of New Zealand.
  6. Te Puni Kōkiri may vary these Terms and Conditions at any time in its sole discretion provided that such amended terms will not affect prior agreed advertisements.
